Capitol Police CLEARS Officer Who Shot and Killed Ashli Babbitt

(Headline USA) An officer who shot and killed a woman during the Jan. 6 siege at the U.S. Capitol as she began to climb through the broken part of a door leading into an area known as the Speaker’s Lobby acted lawfully and in line with police department policy, the U.S. Capitol Police said Monday.
Capitol Police announced the findings of their internal investigation into the fatal shooting of Ashli Babbitt on Monday.
Officials said they had interviewed multiple witnesses and reviewed video and radio calls as part of the monthslong probe.
Federal prosecutors also cleared the officer of any wrongdoing after an investigation into the shooting and did
not publicly name him, despite Babbitt being clearly unarmed.Capitol Police, concerned for his safety, have also not released his name. The officer’s attorney, Mark Schamel, said his client is facing “many credible death threats” and other “horrific threats” and was forced from his home because of them.
Real Clear Investigations has identified the likely officer as Lt. Michael Byrd of the Capitol police.
An attorney for the Babbitt family says she was ambushed by the officer. “There was no warning,” said attorney Terry Roberts.
Babbitt, a 35-year-old Air Force veteran from San Diego, was shot by the police lieutenant when she tried to climb through a door with the glass smashed out as she and others in the mob pressed to get into the Speaker’s Lobby outside the House chamber. She was unarmed.
Prosecutors said Babbitt was part of the mob that was trying to get into the House as Capitol Police officers were evacuating members of Congress from the chamber.
The officers used furniture to try to barricade the glass doors separating the hallway from the Speaker’s Lobby to try to stave off the rioters, who kept trying to break through those doors, smashing the glass with flagpoles, helmets and other objects.
At the same time, Babbitt tried climbing through one of the doors where the glass was broken out.
The officer, inside the Speaker’s Lobby, then fired a single round from his service weapon, striking Babbitt in the shoulder, prosecutors said.
Capitol Police said its office of professional responsibility – which handles such investigations – determined “the officer’s conduct was lawful and within Department policy.”
The officer will face no internal disciplinary action.
The policy says an officer should only use deadly force when they reasonably believe their actions will be in defense of human life – either their own or another person who could be “in immediate danger of serious physical injury,” officials said.

I have no problem with this decision. Justified.
ReplyDeleteAgree. I'm surprised more weren't shot.
DeleteMarxist
DeleteBased on what? The Democrat double standard test?
DeleteGet back in the basement! Mommy has had it with you. Law enforcement cannot use deadly force to deal with trespassers. Unless they are shitting their pants.
DeleteReally I hope you are not a Police Officer how is this a forcible felony? Trespassing and Vandalism for breaking the window at most. Officer could have pushed her back through the window or detained her.
DeleteIf Trump was POTUS and Ashli was black and Byrd was White and it was a BLM situation, Byrd would already have been sentenced to death row and MSM would be playing this 24/7 reporting on Byrd any scrap of dirt they could find but since the races are reversed all you hear is crickets. WTF happened to this country
ReplyDeleteAnd if it was a white officer that shot an unarmed black person??????

ReplyDeleteSo a law enforcement officer, with his weapon trained on an unarmed female, who represented NO threat to his personal safety, nor anyone around her is presumed to represent a threat of death or bodily harm to congressional representatives not present or anywhere within an area to fear for their lives. This doesn't pass the smell test. There is NOT one law enforcement agency in the country that authorizes firing into crowds, which actually constitutes reckless endangerment to others in that crowd. At one point did Lt. Byrd have his weapon unholstered and aimed at this woman? What warnings were issued to anyone in this group? This is total bullshit and a compliant media goes along with it and of course conservative media mentioning this atrocious pre-meditated act of murder are regarded as cranks. I truly hope that this brazen violent incident is not forgotten by anyone going to vote the next time around.
ReplyDeleteUse of deadly force by a police officer is a last-resort measure. This shooting was not justified
