Presiding Judge of the Criminal Division Leroy Martin Jr. is compromised and needs to be investigated!

has conducted himself in a manner which brings into question the integrity and impartiality of the judiciary

What we have here is a judge, a Presiding Judge no less, who is predisposed to make rulings, that are not necessarily legal and objective but which serve the interest of whomever he is beholden to. His son was hired by and is employed by Kim Foxx as an ASA, yet he was ready to make a ruling which would affect Kim Foxx.  This is not a trifle conflict of interest. Indeed it is a conflict which is causing the general public to lose confidence in the judicial system. For that reason, Judge Martin should be removed from his position as Chief Judge immediately and the case should be referred to the Illinois Judicial Inquiry Board for investigation. 

Among the issues to be investigated are:

  • How was Judge Martin appointed Chief of the Criminal Division?
  • How was Judge Martin's son hired as an assistant states attorney?
  • Since his son was hired, how many times has Judge Martin reclused himself in matter affecting the state?
  • Since his son was hired, has Judge Martin made any rulings which favored the state's position in a case?
  • Since his son was hired, has Judge Martin made any rulings which adversely affected the rights of the accused? 

 The judge tasked with determining if a special prosecutor should investigate Kim Foxx has a son who works in her office.

Chicago, IL – The judge who will determine whether a special prosecutor should be appointed to investigate the handling of former “Empire” star Jussie Smollett’s case has a son who works for Cook County State’s Attorney Kim Foxx.

Retired Appellate Judge Sheila O’Brien filed a petition on Thursday asking Cook County Judge Leroy Martin Jr. to recuse himself and assign the case to a judge outside the county, FOX News reported.

Rule 62: Canon 2. A Judge Should Avoid Impropriety and the Appearance of Impropriety in All of the Judge's Activities 

A. A judge should respect and comply with the law and should conduct himself or herself at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary. 
B. A judge should not allow the judge's family, social or other relationships to influence the judge's judicial conduct or judgment. A judge should not lend the prestige of judicial office to advance the private interests of others; nor should a judge convey or permit others to convey the impression that they are in a special position to influence the judge. A judge should not testify voluntarily as a character witness.
